Trips agreement flexibilities applied to the transfer of environmentally sound technologies

Abstract
The paper aims how the transfer of environmentally sound technologies pose particular problems that necessitate an enabling legal framework. The paper presents an examination on the Agreement on Trade-Related Aspects of Intellectual Property Rights that sets minimum standards in the international rules governing intelectual property, including patents. The Agreement contains specific obligations that may affect the transfer of clean technologies. It’s important to consider how the Agreement can achieve the transfer of these technologies and how the flexibilities could be implemented. In this regard the Preamble, the Objectives and the Principles are crucial, and also the Vienna Convention on the Law of Treaties and the World Trade Organization jurisprudence (WTO). Finally for Cuba, a developing country and a WTO Member this topic is very important.
