El fundamento moral del Derecho

Resumen
El artículo se ocupa de la venerable cuestión de en qué medida y cómo el derecho depende de la moralidad. En primer lugar, se analiza la cuestión en los términos tradicionales: ¿son las normas injustas dictadas por las autoridades derecho válido? Se sostiene que en este sentido esta es una disputa verbal. En segundo lugar, se analiza la cuestión metafísica, a saber, si el derecho proporciona razones decisivas para actuar; entonces, ¿los contenidos jurídicos existen en virtud de, fundados en, hechos sociales únicamente o también en hechos morales? En tercer lugar, se analiza la cuestión epistémica: ¿la identificación del contenido del derecho depende de la identificación de razones y consideraciones morales? En estos dos sentidos es que el debate entre el positivismo jurídico y el antipositivismo tiene sentido. Se termina sugiriendo que si bien tal vez es concebible que el contenido del derecho sea identificado sin recurrir a la moralidad, dicha identificación no es metafísicamente posible.
