La invalidación del derecho a través de la moral

Resumen
En este ensayo se realiza un análisis detallado de los efectos positivos y negativos de la moral para la validez jurídica del Derecho positivo. Para lograr tal tarea se expondrán y contrastarán la fórmula de Radbruch –con sus dos subfórmulas– y el argumento de la injusticia desarrollado por Robert Alexy. Asimismo se esbozarán los argumentos a favor y en contra de una necesaria conexión entre la moral y el Derecho; lo anterior, al dar un breve vistazo a los postulados del positivismo incluyente y excluyente. Por último, se hablará del papel de “casación” de la moral y su relación con el control jurisdiccional.
